Tr’ondëk Hwëch’in Government (TH) has decided to file a statement of claim in Yukon Supreme Court after years of unsuccessful attempts to resolve the Government of Yukon’s (YG) ongoing failure to meet its obligations under the Tr’ondëk Hwëch’in Final Agreement (THFA).
Despite repeated efforts to negotiate, TH says YG has allowed unlawful and poorly managed encumbering right, such as outdated mineral claims to continue burdening and damaging TH Settlement Land, preventing TH from fully benefiting from the lands guaranteed under the treaty. The legal action seeks to hold YG accountable for longstanding breaches, ensure proper administration of encumbering rights, and obtain compensation for the significant harm these failures have caused to TH and its citizens.
